These Terms of Service ("Terms") govern your use of EverestAI, operated by Tyung and Stellar ("we", "us", "our"), accessible at everestnepal.xyz and chat.everestnepal.xyz. By accessing or using EverestAI, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using EverestAI in any way, you confirm that you are at least 13 years old and have read, understood, and agree to these Terms. If you are using EverestAI on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Description of Service

EverestAI is an AI-powered chat platform designed for Nepali and English speakers, offering features including but not limited to: AI chat, language translation, AI image generation, AI video generation, voice input, Nepal news, and writing assistance. Services are provided "as is" and may change at any time.

3. Account Registration

You must create an account to use EverestAI. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree NOT to use EverestAI to:

• Generate, distribute, or store illegal content
• Harass, threaten, or harm any person
• Spread misinformation, hate speech, or discriminatory content
• Generate content that exploits or endangers minors
• Impersonate individuals or organizations
• Attempt to reverse-engineer, hack, or disrupt the service
• Use the service for commercial spam or unsolicited messaging
• Violate any applicable local, national, or international laws

5. AI-Generated Content

EverestAI uses third-party AI models to generate responses. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. AI responses should not be relied upon as professional legal, medical, financial, or other specialized advice. You are solely responsible for how you use AI-generated content.

6. Intellectual Property

The EverestAI platform, including its design, code, branding, and original content, is owned by Tyung and Stellar and protected by applicable intellectual property laws. You retain ownership of content you submit, but grant us a non-exclusive, worldwide license to use, process, and store that content as necessary to provide the service.

7. Advertising

EverestAI may display advertisements served by Google AdSense and other advertising networks. These ads help us keep the service free. Advertisers are responsible for their ad content. We are not responsible for advertiser claims or linked websites.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or are using the service in a manner harmful to others or to EverestAI.

9. Disclaimer of Warranties

EverestAI is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI responses will be accurate or appropriate for any particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law, Tyung and Stellar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use EverestAI, even if we have been advised of the possibility of such damages.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts in Kathmandu, Nepal.

12. Changes to Terms

We may modify these Terms at any time. We will notify users by posting the updated Terms on this page. Your continued use of EverestAI after changes constitutes acceptance of the revised Terms.
